A toxic tort is defined as a personal injury caused by exposure to a toxic substance, such as asbestos or hazardous waste. Victims can sue for medical expenses, lost wages and pain and suffering by suing the firms responsible, and that is called toxic tort litigation. "Pain and suffering" is a legal term meaning the physical or emotional distress resulting from an injury. Though the concept is somewhat abstract, the injured plaintiff can seek compensation (usually in the form of cash). How much the defendant owes for pain and suffering is calculated separately from the amount owing for more direct expenses, such as medical bills or time lost from work, although sometimes these are factored in to arrive at a reasonable and logical figure. |
